Certification and Release of Information and Liability
I certify that the facts set forth in this application are true, complete, and correct to the best of my knowledge. I understand that any misrepresentations, falsifications, or omissions on this application can be grounds for rejection of my application or, if I am employed by this company, for my immediate termination from employment. I have applied for employment with RDCE, LLC (the “Company”) and I hereby authorize the Company to make inquiries about me to my former employers, educational institutions, credit sources, other listed references, and to check my information against registered sex offender lists and to conduct a criminal background check if desired. I hereby authorize the party receiving this statement to disclose any information they may have relating to my work performance, cooperativeness, ability to get along with coworkers, and other qualifications for employment that may be requested by the Company. Information received will become a permanent part of my personnel file and be treated as confidential by the Company. I waive my right to view this information and I release the party receiving this form from liability for providing this information.
Furthermore, in connection with my application for employment with the Company, I hereby authorize the Company and any of its designated agents (including any consumer reporting agency working on the Company’s behalf) to obtain and review any consumer reports or other credit-related information relating to me. It is my understanding that the information being obtained will not be used in violation of any federal or state equal opportunity laws or regulations, and that before any adverse action is taken based on a review of any consumer credit report and/or investigative consumer report, I will be provided with a copy of said report(s) as well as a summary of consumer’s rights. I hereby fully release the Company, and any and all of its employees, directors, agents, successors, and assigns, and all contributing parties and sources from whom any information is lawfully obtained, from any and all claims, actions, or liability in any way related to this or subsequent investigation(s) of my credit history. I acknowledge receipt of the Fair Credit Reporting Act Disclosure Notice provided below and hereby state that all information I have provided to the Company, in any form, is to the best of my knowledge true, complete, and correct. I understand that any known misrepresentation made by me to the Company will exclude me from further consideration as a candidate for employment or promotion, and may result in termination from my employment with the Company if I am hired or promoted before that misrepresentation is discovered. I understand this authorization, waiver, and release of liability is not an offer or a contract for employment by the Company. I also understand that if I am offered and accept employment with the Company, the Company is not contractually obligated to continue to employ me, and that my employment is “at-will” and for no definite period. This authorization and release does not alter or affect the Company’s at-will employment policy in any manner, and either the Company or I can terminate any future employment at any time, with or without notice.
As an applicant for employment or a current employee of RDCE, LLC (the “Company”), you are a consumer with rights under the Fair Credit Reporting Act. When any of the following circumstances exist, the Company may choose to obtain and use information contained in either a consumer report or an investigative consumer report form a consumer reporting agency about you:
(1) When considering your application for employment;
(2) When making a decision whether to offer you employment;
(3) When deciding whether to continue your employment (if you are hired); or
(4) When making other employment-related decisions directly affecting you.
A “consumer reporting agency” is a person or business that, for monetary fees, dues, or on a cooperative nonprofit basis, regularly assembles or evaluates consumer credit information or other information on consumers for the purpose of furnishing consumer credit information or other information on consumers for the purpose of furnishing “consumer reports” to others, such as the Company.
A “consumer report” is any written, oral, or other communication of any information by a “consumer reporting agency” bearing on your creditworthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of living that is used or expected to be use or collected, in whole or in part, for the purpose of serving as a factor in establishing your eligibility for employment purposes.
An “investigative consumer report” is a consumer report in which information on your character, general reputation, personal characteristics, or mode of living is obtained through personal interviews with your neighbors, friends, associates, or others with whom you are acquainted or who may have knowledge concerning any such items of information.
An investigative consumer report may be requested by the Company. You may request, in writing, within a reasonable time, additional disclosures about the nature and scope of the investigation requested as well as a written summary of your rights under the Fair Credit Reporting Act.
